Introduction

This public hearing will consider adopting the City of Arcata 2019-2027 Housing Element, and an addendum to the 2014 California Environmental Quality Act (CEQA) Negative Declaration and Common Sense Exemption by Council Resolution No. 190-40.  On December 5, 2019, the California Housing and Community Development Department (HCD) submitted a letter to the City indicating the revised 2019-2027 Housing Element met the requirements of State housing element law.

 

Discussion/Fiscal Impact

DISCUSSION:
This meeting provides the Council and the public the opportunity to review and provide input on the final version of the 2019-2027 Housing Element prior to forwarding it to HCD for certification as required by state law.  The City’s Housing Element must be certified by HCD to meet state Housing Element law, and must be adopted by City Council on, or before, December 29, 2019.  The draft Housing Element was submitted to HCD for review and HCD provided staff with amendments necessary prior to certification. Staff and our consultant made the required amendments based on HCD’s comments, as well as public input received during the review period.  These amendments were included in the draft presented to City Council on December 4th.  The Housing Element and appendices (Attachment A, Exhibit 1) have been reviewed by HCD and found to be in compliance with state Housing Element law (Attachment B). The Planning Commission reviewed and provided input on the draft Housing Element over five meetings and, at their December 10, 2019 meeting, adopted Resolution No. PC-19-08 recommending Council adopt the Housing Element and an addendum to the CEQA 2014 Negative Declaration and Common Sense Exemption.

 

ENVIRONMENTAL REVIEW (CEQA):
On July 23, 2014, the City adopted a Negative Declaration (ND) (SCH#2014032042) for the 2014-2019 Housing Element. Under CEQA Guideline Section 15164, an addendum to a negative declaration may be prepared if “…only minor technical changes are required or if none of the conditions identified in Guideline Section 15162 are present”. The proposed Housing Element has been evaluated for significant impacts pursuant to Section 15164. Policies included in the Element are designed to bring the City into compliance with state law, or to increase the availability of housing sites.

 

Some of the programs identified in the 2019 Housing Element will require future action to increase density, or change zoning. However, those actions are speculative under this review and will occur at some point over the next three years. Though these measures are required in this Element, they are too speculative to conduct environmental analysis on. Identifying the need to increase density somewhere in the City in this document as a program, recognizing that the specific rezone will also be subject to independent environmental review, does not itself have an environmental impact. Therefore, it can be seen with certainty that adoption of these programs will not have the potential to impact the environment.

 

The determination is that the potential impacts of the proposed 2019-2027 Housing Element were adequately evaluated in the previously adopted Negative Declaration and the new programs are exempt per the common sense rule (Attachment C). 

 

BUDGET/FISCAL IMPACT:
The cost for the 2019-2027 Housing Element was budgeted in the original budget for the project and no new allocation is required.
